"These terms govern the use of WellDatum HIMS by healthcare institutions and authorized personnel. By accessing the platform, the Institution and its Users agree to these clinical and ethical standards."
1. Authorized Use
WellDatum grants an enterprise license to the healthcare institution. Access is strictly limited to registered medical practitioners and authorized administrative staff.
2. Clinical Disclaimer
WellDatum HIMS is a support tool and not a substitute for professional medical judgment. Final clinical decisions and patient care remain the sole responsibility of the treating physician.
3. Data Fiduciary Roles
The Institution acts as the 'Data Fiduciary' under DPDPA and is responsible for capturing explicit patient consent. WellDatum acts as the 'Data Processor' maintaining platform integrity.
4. IP & Data Ownership
The HIMS software remains the property of PairBytes Software Private Limited. All Patient Health Information (PHI) and institutional databases remain the exclusive property of the Healthcare Institution.
5. Acceptable Use
Users are prohibited from reverse engineering clinical logic or sharing credentials. WellDatum reserves the right to audit system logs to ensure compliance with NMC ethics.
6. Limitation of Liability
WellDatum's liability is limited to the technical performance of the software. We are not liable for clinical outcomes or institutional data breaches caused by local credential leaks.
